GENERAL TERMS AND CONDITIONS OF SALE (GTCS)
Revised and effective from January 1, 2025.
These General Terms and Conditions of Sale and Use (hereafter “GTCS”) govern all distance sales made by FLEURDELYSDOLL, a sole proprietorship registered at the Rennes RCS under number 493 130 967 00018, with registered office at 2A rue de la Forêt, 35140 Gosné (France), represented by Ms. Karine Dodeman, Director.
The GTCS apply to all prospects, consumer customers (hereafter “Customer”) and users (hereafter “User”) of the website accessible at www.fleurdelysdoll.com (hereafter the “Site”).
The GTCS may be modified at any time without prior notice. Customers are advised to regularly check this page before ordering.
Article 1 – General Provisions
1.1 Contract Conclusion – Effective Date
Online orders validated by electronic acceptance (double click, validation, telephone agreement) irrevocably bind the Customer and constitute an electronic signature compliant with current laws (Law No. 2000-230 of March 13, 2000 and LCEN Law No. 2004-575 of June 21, 2004).
1.2 Duration
These GTCS are valid for the duration necessary to provide the products and end of their guarantees.
1.3 Contractual Documents
The Customer will receive a confirmation email which must be kept as proof. Electronic archiving of orders and invoices serves as proof of transactions.
1.4 Validity
The applicable GTCS are those in force at the time of the order.
Article 2 – Products
FLEURDELYSDOLL offers collectible dolls and accessories for sale, with worldwide shipping.
Important: Products are not toys. They may contain small detachable parts that can be ingested or inhaled. They are intended for adults and should be kept out of reach of children under 12 years old or used under adult supervision.
Descriptions and photos are carefully provided, but characteristics may change. Availability is confirmed when ordering. In case of unavailability, the Customer will be informed promptly and may cancel or modify the order.
Article 3 – Order
The Customer guarantees to be of legal age or have parental authorization.
Creating a personal account is necessary to place an order. The password is confidential and the Customer is responsible for its safekeeping. Any unauthorized use must be reported immediately to the seller.
Article 4 – Pre-orders
Pre-orders require a 20% non-refundable deposit. A payment plan may be agreed for orders over €200.
The order is confirmed upon deposit payment. Delivery takes place upon receipt of the balance, after email or phone confirmation.
In case of cancellation by the Customer, the deposit is lost. The seller may cancel the sale for supplier-related reasons, with refund of the deposit within 15 days.
Failure to pay the balance within 15 days results in deposit forfeiture and order cancellation.
Article 5 – Validation and Acceptance
The Customer accepts the GTCS by validating the order. Confirmation is sent by email after payment validation and product availability.
Article 6 – Archiving
The identification system and electronic archiving of orders constitute proof of the contract. Documents are securely stored and can be provided upon request.
Article 7 – Prices
Prices are shown in Euros including all taxes (VAT not applicable, article 293 B CGI), excluding shipping fees.
Taxes and customs duties may apply depending on the destination country, at Customer’s expense.
Prices may be changed at any time, but billing is based on the price in effect at the time of order.
Article 8 – Payment
Payment is due at order via credit card through PAYPAL (secure site), check (French bank account) or bank transfer (France and Europe).
Late payments incur penalties at 1.5 times the legal interest rate, without prior formal notice.
The seller reserves the right to request identity proof before accepting the order.
Article 9 – Delivery
Delivery is made to the address provided by the Customer within the communicated deadlines. In Europe, average 8 working days; outside the EU up to 30 working days.
The Customer chooses between standard shipment without insurance and insured shipment with signature. Only insured shipments are indemnifiable in case of loss or damage.
The Customer must check the merchandise upon delivery and report any anomalies on the delivery slip, then by registered mail within 48 hours.
Order tracking is available in the Customer’s account.
Article 10 – Withdrawal Right – Returns
The Customer has 7 calendar days from delivery to exercise the withdrawal right according to applicable regulations.
Products must be returned in original packaging, complete, undamaged, with all accessories and invoice.
Refund (excluding return shipping) will be made within a maximum of 1 month from receipt of the returned product.
In case of non-conformity or delivery error, the Customer must notify within 48 hours.
Article 11 – Warranty
Products benefit from legal warranties (manufacturer’s warranty and legal warranty against hidden defects).
Claims must be justified and sent electronically.
Article 12 – Transfer of Ownership
Product ownership is transferred to the Customer after full payment, regardless of delivery date.
Article 13 – Liability
Photos, descriptions and features are provided as indication only. FLEURDELYSDOLL is not liable for typographical errors or supplier modifications.
Liability cannot be held in case of force majeure or transport incidents.
Article 14 – Personal Data – GDPR
Personal data collected during ordering is necessary for processing and delivery.
Under GDPR (EU Regulation 2016/679), the Customer has rights of access, correction, objection and deletion of personal data, exercised by mail or email at contact@fleurdelysdoll.com.
Data will not be shared with third parties without consent, except legal obligation.
Article 15 – Intellectual Property
Texts, photos, logos and site elements are exclusive property of FLEURDELYSDOLL or its partners. Any reproduction or use without authorization is forbidden.
Article 16 – Applicable Law – Jurisdiction
These GTCS are governed by French law.
In case of dispute, amicable settlement will be sought before legal action. Failing that, Rennes courts shall have jurisdiction.
